The agreement for using Pre-Trip: the scanner, your account, entitlements, the API, and the integrations. Plain where we can be, exact where it counts.
These Terms of Service (the "Terms") govern your access to and use of the Pre-Trip compliance scanner, the web application at scan.kesey.agency, the marketing site at kesey.agency, the Pre-Trip application programming interface and developer materials (the "API"), and the official plugins and connectors (together, the "Service"), provided by Gulf Ice Solutions LLC, doing business as Kesey Agency ("Kesey", "we", or "us").
By creating an account, running a scan, creating an API key, or otherwise using the Service, you ("you") agree to these Terms. If you use the Service for an organization, you represent that you are authorized to bind it, and "you" includes that organization. If you do not agree, do not use the Service.
Pre-Trip screens marketing copy against curated, source-cited compliance rulesets for regulated health verticals and returns a pass or a fix list. It is offered through the web application, the API, and official integrations such as the WordPress plugin and the MCP server. The rulesets, patterns, and scoring logic are ours and are described in Section 9.
You need an account in good standing to run scans beyond the free trial and to create API keys. Sign-in is passwordless: we email a one-time link. You are responsible for your account and for all activity under it, and for keeping your sign-in email and API keys secure. Tell us at support@kesey.agency if you believe your account has been compromised.
The Service offers one free check per asset type per account, through the web application only. Beyond the trial, you buy scan tokens (one-time) or a Bus Pass (a monthly allowance that does not roll over). Each scan resolves in this order: free trial, then Bus Pass allowance, then token balance. When all are exhausted, a scan returns an out-of-scans response with a link to buy more. The free trial is not available through the API; API scans resolve the Bus Pass allowance, then tokens.
Prices are those shown at kesey.agency at the time of purchase and may change. Purchases are handled by our payment processor at checkout. Except as required by law, entitlements and fees are non-refundable. A scan that fails after consuming an entitlement is refunded automatically. You are responsible for any taxes other than taxes on our net income.
You will use the Service only for lawful purposes and only to screen marketing copy you have the right to submit. You will not:
A material violation of this section is a breach of these Terms.
Scanned, not kept. The copy, URL, or image you submit to be scanned (your "Content") is processed in memory to run the check and is not stored: not in our database, not in logs, not in analytics. For each scan we record only aggregate metadata, such as the verdict shape, counts, and the identifiers of the rulesets applied, for usage, rate limiting, and billing. Video scans involve a short transient-processing window described in our Privacy Policy. If the advisory layer is enabled, rule descriptions and the text under review are sent to our AI processor to generate advisory notes, with no account identity attached and not retained for training.
You are responsible for having the rights and permissions needed to submit your Content, including any client authorizations and any notices or consents required for the people or businesses named in it. How we handle data is described in the Privacy Policy and explained plainly on the Trust page.
Rulesets that are pending review, past their review clock, or covering a jurisdiction with no adopted rules fail closed: they flag rather than pass, and the result says so. You are solely responsible for what you publish and for obtaining your own legal review where appropriate. You will not represent to any third party that Pre-Trip or Kesey has approved, certified, or assumed responsibility for your Content.
An API key is a secret bearer credential that maps to one account. Treat it like a password: do not embed it in client-side code, public repositories, or anything a third party can read. You are responsible for scans charged to a key until you revoke it. We apply per-key rate limits, described in the developer documentation and signaled in response headers, and may adjust them to protect the Service. Official integrations, including the WordPress plugin and the MCP server, are covered by these Terms when used with your account.
The Service is provided on an "as available" basis. Unless a separate written agreement says otherwise, we do not commit to an uptime service level for the self-serve Service. We may add to, change, or deprecate features. We version the API in the request path, and for a change that is not backward compatible within a version we will use commercially reasonable efforts to give advance notice and, where practical, keep the prior version available for a transition period.
As between us, you own your Content. You grant us the limited, non-exclusive right to process your Content solely to provide the result and the Service to you, consistent with Section 5. We own the Service, the API, the rulesets, the patterns, the scoring logic, and all related intellectual property. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with them. You may retain and use the results you receive for your own compliance and record-keeping, but not to reconstruct or compete with the rulesets. If you send us feedback, we may use it without restriction or obligation to you.
You may stop using the Service at any time and revoke your keys. We may suspend or terminate access, in whole or in part, if you breach these Terms, if your account is delinquent, if your usage threatens the security, integrity, or availability of the Service, or if we are required to by law. Where practical, and where the reason is not an active security or legal risk, we will aim to give notice and an opportunity to cure. Sections that by their nature should survive termination will survive, including Sections 5, 6, 9, 11, 12, 13, and 14.
The Service and the results are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the results are accurate, complete, current, or that Content that passes will be found compliant by any regulator, platform, or court. Some jurisdictions do not allow the exclusion of certain warranties; in that case the exclusions apply to the fullest extent permitted.
To the fullest extent permitted by law, neither party is liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service, even if advised of the possibility. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms and the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim, or one hundred US dollars.
Because Pre-Trip is a screen and not legal advice, we are not liable for regulatory findings, penalties, platform actions, or other outcomes arising from Content you chose to publish. The allocation of risk in these Terms reflects that.
You will defend, indemnify, and hold harmless Kesey and its affiliates from and against third-party claims and related losses arising out of your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. You and Kesey submit to the exclusive jurisdiction of the state and federal courts located in Wyoming for any dispute arising out of or relating to these Terms or the Service. Each party waives any objection to venue in those courts.
We may update these Terms. If a change is material, we will use reasonable efforts to post notice on the Service or notify your account contact before it takes effect, and continued use after the effective date is acceptance. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger or sale. These Terms, with the documents they incorporate, are the entire agreement about the Service. If a provision is unenforceable, the rest remains in effect.
